The Scottish Mental Health Law Review Group’s consultation looks at proposals for major reform of mental health and adults with incapacity legislation in Scotland and embedding human rights enablement in future laws in this area. The College is particularly interested in issues around guardianship and has real concerns about how delays in the current system can lead to a significant number of delayed discharges from hospital. The Scottish Mental Health Law Review Group will send a final report to Scottish Ministers by the end of September 2022.
